Terms of Service

1. About these terms
These terms are an agreement between you and Club Funding Limited (NZBN 9429053998071), a New Zealand company ("Club Funding", "we", "us"). They apply to every club, association and individual using Club Funding (the "Service"). By accepting an invitation or using the Service, you agree to these terms. If you accept on behalf of a club, you confirm you're authorised to do so. If you're a parent or guardian setting up access for an athlete under 18, you accept these terms on their behalf.
2. Accounts and access
- Access is by invitation. Club accounts are set up for a nominated club contact. Individual accounts are set up for an adult athlete, or for the parent or guardian of an athlete under 18.
- You're responsible for keeping your contact details current, for who in your club has access, and for keeping your sign-in links private. We sign you in by emailed link, so please don't forward those emails.
- Tell us straight away at hello@clubfunding.nz if you think someone has accessed your account without permission.
3. Club accounts and committee changes
A club account belongs to the club, not to the person who set it up. When committee roles change, the club can ask us to transfer the account to a new contact by emailing hello@clubfunding.nz from a current committee member. We may ask for reasonable confirmation (for example, from the club's president or secretary) before making the change.
4. What the Service does
The Service helps clubs and athletes find funding relevant to their area and sport, keep club readiness information in one place (such as documents, AGMs and officers), track applications, generate resolution letters, and draft application content with the AI Grant Writer. We don't apply for funding on your behalf, and we aren't a funder.
5. Funding information
We work to keep funder information accurate and check it against funders' own sources. Funders can change their rules, rounds and amounts without notice, so always confirm current criteria, deadlines and amounts with the funder before applying. Where our information and the funder's differ, the funder's is correct.
6. AI-generated content
- The AI Grant Writer drafts content from information you've provided. It's designed not to invent figures or claims, but it can make mistakes.
- Anything it produces is a draft. It isn't guaranteed to be accurate, complete or suitable to submit without review.
- You're responsible for checking all facts, figures and claims before submitting anything to a funder.
- We're not liable for the consequences of submitting AI-generated content without proper review, including a declined application, damage to a funder relationship, or reputational harm.
7. Funding outcomes
We provide information and tools to support funding applications. We don't guarantee that any application will succeed, that any funder will consider an application, or that our information covers every possible funder.
8. Prices, trials and payment
- Clubs: $35 a month or $378 a year, per club.
- Families: free when the athlete's club has an active Club Funding subscription. Otherwise $10 a month or $108 a year per family, covering all athletes who live in the same household and are managed under one parent or guardian account. Athletes in other households, including extended family, need their own family subscription.
- Prices are in New Zealand dollars and include GST, if any.
- Free trial: new clubs may be offered a 14-day free trial, starting once your club's set-up is complete. No payment details are needed to start. If no subscription is set up by the end of the trial, you'll see a payment screen until you choose card or invoice (see section 10).
- Payment is by card through our payment provider, Stripe, or for clubs on annual plans, by invoice. Invoices are due within 20 days.
- Subscriptions renew automatically at the end of each monthly or annual period until cancelled.
- If a payment fails or an invoice isn't paid by its due date, the process in section 10 applies.
- We'll give at least 30 days' notice by email of any price change, which then applies from your next renewal.
- We may provide complimentary access at our discretion, for example for pilot clubs. We'll give at least 30 days' notice before complimentary access ends or becomes paid.
9. Cancellation and refunds
- You can cancel at any time by emailing hello@clubfunding.nz, or through your account where that option is available. Cancellation takes effect at the end of your current paid period, and you keep access until then.
- We don't refund partial periods, except where we've made an error or where the law requires it.
- Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or other New Zealand consumer law that can't be excluded.
10. When access ends or payment lapses
- At the end of a free trial, you'll need to choose card or invoice to keep using the Service. Until you do, you'll see a payment screen, and you can still export your information.
- If a payment fails or an invoice isn't paid by its due date: for the first 14 days you keep full access while we remind you. From day 14 your account is read-only (you can view and export your information). From day 60 it's disabled (you can only pay, export your information, or ask us to delete it). From day 90 your data is scheduled for permanent deletion.
- If you cancel, your access continues to the end of your paid period. After that, the same timeline applies, starting at the read-only stage.
- We'll email you at each stage, including 7 days before deletion. Paying at any stage restores full access.
- If you need more time, for example while waiting on a committee meeting, contact us and we can pause this process.
- You can ask us to delete your data at any time.
- We keep billing records as required by law, even after other data is deleted.
11. Your content and ours
- Your club's information, documents and drafts remain yours. You permit us to store and process them only to provide the Service.
- The Service, including its software, design and funder database, belongs to Club Funding Limited. You may use funder information for your own club's or athlete's funding, but you may not copy, scrape, republish or resell it.
12. Naming clubs and testimonials
We won't name your club, athletes or committee members publicly, including on our website, in marketing or in conversations with funders or sport organisations, without your permission.
13. Sponsors and sponsored grants
We're developing ways to bring new money into community sport through sponsors, including sponsor-funded grants that participating clubs can apply for.
- When this launches, we'll invite clubs to join a sponsor programme. Clubs that join agree to share occasional sponsor posts with their networks, and in return become eligible to apply for sponsor-funded grants.
- Joining is always optional. Your club's access to the rest of the Service doesn't depend on it.
- You choose which posts to share and can decline any of them. We'll never post on your behalf.
- We won't ask clubs to promote alcohol, gambling or anything unsuitable for junior members.
- We won't share your club's details with sponsors without your permission.
- We'll explain the programme's details before you decide whether to join.
14. Anonymised information
We may use anonymised, aggregated information (for example, how many clubs in a region match a type of funding) to improve the Service and to report on community sport funding. This never identifies a club, athlete or person.
15. Feedback
If you send us suggestions or feedback, we may use them to improve the Service without any obligation to you.
16. Support access
To help with onboarding and support, our administrator can view and update a club's account ("view as" support access). Every action taken this way is logged. We only use it to help you or to keep the Service running.
17. Acceptable use
You must not use the Service to submit false information, misrepresent eligibility, access or attempt to access data belonging to another club or person, share your account outside your club or family, or interfere with the Service's security or operation.
18. Availability and changes to the Service
We aim to keep the Service available and working well, but we can't guarantee it will be uninterrupted or error-free. We may improve, change or remove features over time. If a change materially reduces what you've paid for, we'll tell you in advance.
19. Links to other websites
The Service links to funders' and other organisations' websites. We're not responsible for their content, availability or practices.
20. Events outside our control
We're not responsible for delays or failures caused by events outside our reasonable control, such as outages at our service providers, natural disasters or internet failures.
21. Liability
- To the extent permitted by law, we're not liable for any indirect or consequential loss, or for lost funding, missed deadlines or decisions made by funders.
- To the extent permitted by law, our total liability to you in connection with the Service is limited to the fees you paid us in the 12 months before the claim arose, or $100 if you haven't paid any fees.
- Nothing in these terms excludes or limits liability that can't be excluded or limited under New Zealand law.
22. Suspension and ending access
We may suspend or end access if these terms are seriously or repeatedly breached, if payment remains overdue as set out in section 10, or if we need to protect the Service or other users. Where reasonable, we'll contact you first.
23. Resolving concerns
If you have a concern about the Service, please contact us first at hello@clubfunding.nz. We'll do our best to resolve it quickly and fairly.
24. Changes to these terms
We may update these terms from time to time. We'll give at least 30 days' notice of material changes by email to club and account contacts.
25. General
If any part of these terms is found to be unenforceable, the rest still applies. We may transfer these terms to a new owner of the Service, and we'll tell you if that happens. We'll send notices to the email address on your account.
26. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
